HOW DOES A CUBENSIS SPORE KIT DIFFER FROM A CUBENSIS SPORE SYRINGE OR SPORE PRINT?

WHY SOME LEGAL EXPERTS BELIEVE THAT MUSHROOM GROW KITS COULD BE ILLEGAL

So why do some legal experts believe mushroom grow kits could be illegal? It’s good to start by examining the Controlled Substance Act, which classifies cubensis as a Schedule I substance. The Act also outlines other laws, including selling drug paraphernalia, which is illegal, and a mushroom grow kit could fall under this section. Interestingly enough, dropping the title from mushrooms could eliminate any legal trouble, as mushroom growing kits are perfectly legal.

It is also illegal to “attempt to conspire” to break any laws within the Controlled Substance Act. Unrelated to this Act, it is also illegal to “aid and abet” a crime, which a mushroom vendor could be doing with mushroom growing kits. So, how do online sellers continue to produce mushroom kits? THE DEVIL IS IN THE DETAILS: HOW SO MANY VENDORS “GET AWAY” WITH SELLING MUSHROOM SPORE KITS

Many vendors who sell mushroom grow kits are able to do so for several different reasons:

  • The kit doesn’t include spores at all, or only includes spores of non-cubensis containing fungi (such as, say, pearl oyster spores). In these cases, while the branding and implication of the product might suggest mushroom cultivation, the product falls into a gray “technically legal” area. Some legal experts may disagree, though, based on the Controlled Substance Act.
  • The kit includes no marketing or branding which could indicate that it may be used to cultivate cubensis-containing fungi, meaning it is simply a mushroom growing kit. In this case, the buyer is at no risk at all. Major retailers can even carry mushroom cultivation kits for amateur mycologists.
  • The highest risk kits will include cubensis spores. While the kits and cubensis spores are legal, the implication may be that it will be used for mushroom cultivation.

CERTAIN MUNICIPALITIES HAVE DECRIMINALIZED CUBENSIS!

It is crucial to always be careful noting the difference between decriminalization and legalization, which we discussed in an earlier article (this is very important, so if you skimmed that bit, scroll back up and read it!). The three municipalities in the Untied States which have decriminalized cubensis are as follows:

  • DENVER, COLORADO
  • OAKLAND, CALIFORNIA
  • SANTA CRUZ, CALIFORNIA
